This document specifies the actions required to evaluate and check the consistency of a negative result of a Formal Vote on a European Standard (EN), and to decide on the future of the draft European Standard (FprEN).
The following procedure applies to the CEN National Members, the Technical Board (BT), the Technical Committees (TC), the TC Secretary and Chairperson and the CEN-CENELEC Management Centre (CCMC). |

3.1 On receipt of a negative result on a Formal Vote, the TC Secretary analyses the justification of the negative votes and logs any inconsistencies.
NOTE Justification for a negative Formal Vote is sometimes completely new and has not been submitted during the drafting of the document or at Enquiry stage or is even contradicting the Member's position given at Enquiry stage. This is considered to be inconsistent behaviour (resolution BT 85/1996). |

3.2 In case of inconsistencies, the TC Secretary or Chairperson requests the CEN National Member concerned to reconsider its vote.
NOTE Any CEN National Member changing its vote must notify that change through its BT Member to the BT Secretariat together with a justification for the change of vote and modified comments, if needed. This change will be communicated, together with a revised voting report, via Livelink and the Weekly Output file. |

3.3 If the negative vote is turned into a positive vote and the results now lead to the acceptance instead of the rejection of the EN, the procedure for the Finalisation and implementation of European Standards is followed. |

3.4 If the voting results of the first Formal Vote remain negative, the TC decides (by taking a delegated resolution) on one of the following actions:
- to submit a modified version of the FprEN to a second Formal Vote (go to the 'Formal Vote' procedure);
- to submit a modified version of the FprEN to the Unique Acceptance Procedure (UAP – see Unique Acceptance Procedure);
- to submit a modified working document to CEN Enquiry and Formal Vote (go to the procedure 'CEN Enquiry');
- to transfer the work to ISO within the framework of the Vienna Agreement, if appropriate;
- to change the type of deliverable;
- to stop the work, delete the work item and release the standstill (see GD – Standstill for more information concerning the standstill principle).
If the voting results of a second Formal Vote remain negative, the TC refers the matter to BT for handling via the principle of management by exception.
