1. Scope    Supporting Tools

This document specifies the actions required to prepare, approve and implement European Standards (EN) intended to be cited in the Official Journal of the European Union under (a) New Approach Directive(s).

NOTE In this Process, ‘Directive’ can also mean ‘Regulation’

The following procedure applies to the CEN National Members, the Technical Committees (TC), their Subcommittees (SC) and Working Groups (WG), the CEN Technical Board (BT), the New Approach Consultants, the EC and EFTA Secretariat and the CEN-CENELEC Management Centre (CCMC).

NOTE 1 The following procedure only covers the additional actions that are required when the EN is intended to be cited in the Official Journal. All processes relevant to ENs in general are applicable as well.

3. Process    

3.1 The European Commission (EC) mandates CEN to develop a standard in support of a New Approach Directive.

NOTE  In principle, the EFTA Secretariat addresses a parallel mandate to CEN.

   

3.2 BT assesses the mandate in accordance with the guidance document on mandates.

3.3 In case of acceptance by BT, the responsible TC and/or SC and/or WG study the mandate and the New Approach Directive.

   

3.4 The responsible TC and/or SC and/or WG prepare one or more working documents (draft standards) in accordance with the mandate in order to support Essential Requirements of the New Approach Directive. The appropriate New Approach Consultant(s) advise(s) and assist(s) the TC, SC and/or WG as early as possible.

3.5 The TC Secretary transmits the working document via E-Trans to CCMC for submission to the CEN Enquiry. The working document shall include the compulsory sentence in the foreword and an Annex Z.

   

3.6 CCMC launches the CEN Enquiry in accordance with the procedure for CEN Enquiry.

   

3.7 During the Enquiry stage, CCMC requests the appropriate CEN Consultant(s) to evaluate the conformity between the prEN, the terms of the relevant mandate and the essential requirements of relevant directives.

   

3.8 The CEN National Members and the New Approach Consultant(s) submit their reply and their comments (prepared using the CEN Commenting Form) onto the E-balloting platform on Livelink.

3.9 CCMC establishes the voting report, compiles all the received comments and dispatches both the report and the comments via
E-Trans to the CEN National Members, the Associates, the Affiliates, the EC and EFTA Secretariat, the TC Chairperson and Secretary.

3.10 After the deadline of the CEN Enquiry stage, the TC Secretary follows the general procedure for CEN Enquiry.

   

3.11 The TC Secretary transmits the final draft via E-Trans to CCMC for submission to Formal Vote.

   

3.12 The CEN National Members are requested to translate the title of the draft in their national language and to deliver it to CCMC via iProjex at the latest before the date of ratification (dor) of the standard.

NOTE  All translations of titles of European Standards, ratified (dor) as from 2010-01-01, shall be identical to the original English, French or German version used to produce them, and shall not include additional national elements.

3.13 Before the Formal Vote, CCMC requests the appropriate New Approach Consultant(s) to assess the final draft as proposed by the TC within 4 weeks (28 days).

   

3.14 If a positive assessment is received from the New Approach Consultant(s), CCMC launches the Formal Vote (go to Clause 3.16).

   

3.15 If a negative assessment is received from a New Approach Consultant, CCMC, the TC Chairperson, the TC Secretary, the New Approach Consultant, the WG Convenor and WG Secretary, as appropriate, examine which follow-up actions are required. Possible actions are: reprocessing the draft by the TC, limiting the scope, pursuing the adoption procedure whilst in parallel requesting the TC to prepare the necessary complement i.e. amendment or complementary draft, etc.

In practice, the discussions can lead to the following results:

  • agreement that the prEN must be modified before submission to Formal Vote: the TC Secretary will provide a new final draft (go to Clause 3.11);
  • agreement that the prEN can proceed to Formal Vote: the Consultant will withdraw his/her negative assessment (go to 3.16);
  • no agreement: BT will be asked to decide on the way forward.
   

3.16 CCMC and the CEN National Members follow the procedure for Formal Vote.

   

3.17 Upon a positive result of the Formal Vote, CCMC makes the adopted EN available and notifies the EC and EFTA Secretariat.

   

3.18 Several times a year, CCMC compiles all the available translations of titles (as well as additional information) and makes them available to EC and EFTA thereby requesting the EC to cite the EN in the Official Journal of the European Union.
